CONDITIONS OF SALE
In these Terms and Conditions of Sale, "GiveMeFit", "we" and "us" mean "Wofitness, SL" and "You" means you, the customer.
These general conditions of sale (hereinafter the "conditions of sale") regulate the legal relationship arising from the purchase and sale processes carried out by you on the website located at the url and its owner, WoFitness, SL, with CIF B88126305 and address at Av. De La Fuente Nueva, 4 28703. San Sebastián De Los Reyes. Madrid. And registered in the Mercantile Registry of Madrid in Volume 37805 Book 0 folio 172 Section 8 Sheet M673454 Entry/annotation 1. You accept the conditions of sale from the moment you use or contract the service or purchase any product. This document can be printed and stored by you. 1. PLACING YOUR ORDER.
1.1. To be able to place an order you must be 18 years old and have the capacity to enter into a contract.
1.2. You can place your order through our online store at www.givemefit.com. Orders that arrive in a manner other than that indicated above will not be accepted.
1.3. Once the order has been accepted, we will send you an email confirmation which will also contain the order number. The order confirmation will be effective from the moment it is sent. If we are unable to process your order due to any problem, we will contact you by email or by calling the telephone number indicated in your customer file.
1.4. To place an order on GiveMeFit, you need internet access to connect to www.givemefit.com. You must register as a user by filling out the electronic form before starting the purchase process. Once registered, you can continue with the purchase process of the product or products added to the basket or browse the website to add new products to it.
1.5. Once you have registered and have all the required products in your basket, you can continue shopping by reaching the screen for selecting Payment Methods, Shipping Methods and Modifying (if required) the billing and/or shipping information. The accepted Payment Methods and their conditions are as specified on the Payment Methods page. The Shipping Methods available and their characteristics and costs are as specified on the Shipping Methods page.
1.6. Once the purchase has been made and as soon as possible, GiveMeFit will send customers an email with the order confirmation and an attached PDF document with the order receipt containing the purchase summary, as well as payment information if applicable and shipping and billing information.
2. SUPPLY OF YOUR ORDER.
2.1. We will supply you with the products specified in your order confirmation, subject to these terms and conditions of sale.
2.2. Orders are received twenty-four (24) days a year, three hundred and sixty-five (365) days a year, although orders placed after fifteen (15) hours will not be processed and will be processed on the following business day in the city of Madrid. Orders received during the weekend will be processed first thing on the following Monday or first business day.
3. PRICES.
3.1. The price of the products includes the corresponding VAT and will be the one indicated in your order and/or invoice.
3.2. VAT at the applicable rate indicated on your invoice will be the responsibility of the customer.
3.3. Shipping costs, where applicable, will be borne by the customer, as indicated in their order and invoice.
3.4. Shipping conditions exclude the Canary Islands, Ceuta and Melilla.
4. PAYMENT OF YOUR ORDER(S).
4.1. You can pay for your products using the payment systems listed in the payment methods section of our online store: Payment Methods
4.2. You must pay in the currency indicated on your invoice. We will only accept payments in Euros.
4.3. If you pay by credit card, you must provide your credit card details when placing your order. We only accept payments with secure cards where your identity as the cardholder is authenticated according to the method established by your bank, through the secure e-commerce service ("Verified by Visa" and "MasterCard SecureCode").
4.4. If you pay by bank transfer/deposit, the necessary payment details will be sent to you by email. Your order will not be reserved or shipped until payment has been received in our bank account. If we do not receive full payment within four (4) working days from the date of your order, it will be cancelled. If you send us proof of transfer, the process may be expedited, but it will not be used to validate it.
5. DELIVERY OF YOUR ORDER.
5.1. We will ship your order to the shipping address listed on your order request.
5.2. We will dispatch your order within the delivery time stated on our website on the date of issue of your order confirmation. If you have ordered several products in one order, we may deliver them to you on different dates. You may cancel your order at any time before it is dispatched by sending an email to returns@givemefit.com stating your order number.
5.3. When your order is delivered to our carrier, we will send you a shipping confirmation to the email address you provided when placing your order. In the shipping confirmation, we will provide you with the tracking number for your shipment so that you can track it through our carrier's website, according to the shipping method you have selected.
6. SATISFACTION OR RETURN. RIGHT OF WITHDRAWAL.
6.1. If you are not satisfied with any of the products in your order, you may exercise your right to withdraw and request a refund within the first 14 calendar days. This period may be extended from time to time according to special temporary promotions, which will be conveniently communicated by the usual means.
6.2. In order to exercise the option to return an order/product or cancel a service contract with which you are not satisfied, you must send an email to returns@givemefit.com , attaching the order number and including your contact details, so that we can provide you with a returns number (RMA) and instructions on how to return the order/product. You must return the products of the order in perfect condition, with all documentation (installation manual, cables...) and without damage.
6.3. If the consumer wishes to withdraw from the order, he/she must notify us through an unequivocal statement by any means permitted by law (e-mail or telephone).
The period for exercising this right is 14 calendar days from receipt of the product or from the conclusion of the contract if it involves the provision of services, with no penalties for its exercise;
The return shipping costs will be borne by the customer. You can consult the shipping conditions in the shipping section of this website. We will send you the instructions and the costs will be deducted from the refund of the order amount. If you use our logistics service, the consumer will be reimbursed for the total amount paid for the order, including the shipping costs of the first shipment.
6.4. Without affecting the consumer's right of withdrawal or the warranty liability for defective products, GiveMeFit's civil liability for the products supplied shall be limited to the amount thereof.
6.8. If the product is defective from the factory, you must send an email to incidencias@givemefit.com with the order number and explaining the product defect. We will send you an email indicating how to send the defective product to GiveMeFit or we will open an incident with the manufacturer. Once the defective product has been received and checked, we will send you another one in exchange at no additional cost. In this case, the exchange will be made for the same item or reference. GiveMeFit will cover the shipping costs corresponding to the return and new shipment.
6.9. When the product, by mistake, does not correspond to the one ordered, GiveMeFit will bear the costs of collecting the wrong product and delivering the one corresponding to the order placed.
6.10. In the event of a return, the refund of the amounts paid will be made through the payment method used for the purchase.
6.11. GiveMeFit will not refund the amount or resend any merchandise until the receipt and condition of the packaging and accessories of the product being returned or exchanged have been verified in our warehouse. The amount to be refunded is the amount originally stated in the order.
6.12. If upon receiving the package you notice that the box has arrived defective or you believe that it may have been tampered with, you should not accept the package and should contact us immediately. If you have accepted a damaged or tampered package, you should contact us as soon as possible so that we can process the transaction with the transport company via email: incidencias@givemefit.com
7. WARRANTY.
7.1. All products that you can buy at www.givemefit.com have a legal guarantee of two (3) years from delivery. For companies and self-employed persons, this guarantee is one year. You can consult the extended guarantee conditions in the " Guarantees " section of this website.
7.2. In the event of a defective product, GiveMeFit shall proceed, as appropriate, to repair, replace, reduce the price or terminate the contract, which shall be free of charge for the customer. GiveMeFit is liable for any lack of conformity that becomes apparent within a period of 2 years from delivery to the user or consumer. You, the consumer and user, must inform GiveMeFit of the lack of conformity within two (2) months from the time you became aware of it.
7.4. If after carrying out the product review, no defect is detected or the problem is not covered by the warranty, GiveMeFit may claim the amount of the shipping costs for the processing, both outbound and return.

9. CONTENTS AND INFORMATION PROVIDED ON OUR WEBSITE.
9.1. GiveMeFit reserves the right to modify the commercial offer on promotions on the website www.givemefit.com (those promotions that are in effect at the time of the user's purchase will be respected) at any time.
9.2. GiveMeFit makes every reasonable effort to ensure that the information displayed on its website is accurate and free of typographical or stock errors. If any such error occurs, which is at all times beyond the control of GiveMeFit, it will be corrected immediately as soon as it is detected. If the error occurs in any of the prices displayed or product availability and a customer has made a purchase, we will inform them of the error and a solution will be proposed immediately.
9.3. GiveMeFit extracts the characteristics and descriptions of the products offered on the website from the information provided to GiveMeFit by manufacturers and distributors and, in some cases, from their own websites. In the event that the information on the product does not correspond to the actual characteristics, the customer may cancel the order at no cost to them.
10. DATA PROTECTION.
WoFitness, SL with CIF B88126305 is the Controller of the personal data that you provide to us and informs you that these data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April, Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights, and Law 34/2002 of 11 July on information society services and electronic commerce.

11. FORCE MAJEURE.
We will use our best endeavours to fulfil our obligations arising from your order. However, we will not be liable for delay or failure to perform if the delay or failure is due to force majeure. In the event of delay, we will fulfil our obligations as soon as reasonably possible.
12. NULLITY AND INEFFECTIVENESS OF THE CLAUSES.
If any clause included in these conditions of sale is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will affect only said provision or the part thereof that is null or ineffective, the conditions of sale remaining in force in all other respects, such provision, or the part thereof that is affected, being considered as not included.
